Cookies are strings of small text which the sites visited by the user send to the user's terminal (usually to the browser), where they are memorized and then sent back to the same sites the next time the same user visits them. While surfing a site, the user’s terminal can also receive cookies sent by various sites and web servers (i.e. third parties), which can contain certain elements (such as images, maps, sounds, specific links to the pages of other domains) that are present on the site which the user is visiting.
Cookies, which are usually present in high numbers in users' browsers, sometimes with highly persistent repetition, are used for different aims: IT authentication, session monitoring, memorization of information about specific configuration concerning the users who access the server, etc.
In order to make sure that the directive is correctly regulated, the Guarantor has identified two macro-categories of cookies: technical cookies and profiling cookies, and has simultaneously defined a further differentiation regarding whoever installs the cookies: this could be the editor of the site or a third party who installs the cookies on behalf of the first one, defining this type of cookies as third party cookies. In the latter case, the Guarantor has expressly limited the responsibility of the editor to sending the information note to whoever installed these cookies.
Technical cookies are those used only in order to transmit communication to a network of electronic communication, or to the extent strictly necessary for the supplier of a service to send the information company, subscriber or the service that they have explicitly requested (Art. 122, paragraph 1 of the Code).
The latter cookies are not used for extraneous purposes and are normally installed by the owner or manager of the site. The cookies can be split up into navigation and session cookies that guarantee that the website can be surfed and used normally (allowing the user to, for example, make purchases or to log in to reserved areas); cookie analytics, along with technical cookies, used directly by the manager of the site to collect information in the aggregated form, based on the number of users and the way they use the site itself; functional cookies that allow users to surf on the basis of selected criteria (i.e. the language, product selected for the purchase) in order to improve the service itself.
To install such cookies, prior consent is not required, while it remains mandatory to provide the informative note in accordance with Article no. 13 of the Code.
Profiling cookies are designed to create profiles related to the user, and are used in order to send advertising messages reflecting the preferences that the consumer expresses while browsing the web. Because of the intensive intrusiveness that these cookies can have on a user’s privacy, Italian and European regulations require that the user must be properly informed on the use of the cookies and can therefore express his valid consent.
Article no.122 references the users, and rules that "Storage of information in the terminal device of a contractor or of a user, or access to the stored information, is only allowed on condition that the contractor or the user expressed their consent after being informed through simplified procedures according to Article no.13, paragraph 3 (Art. 122, paragraph 1, of the Code).
